Petição pelo fim da violência policial discriminatória e racista / Petition for the end of discrimination and racism in the Portuguese police force

Somos um grupo de cidadãos atentos, de diferentes quadrantes da sociedade Portuguesa, que vêm por este meio expor um assunto que entendemos ser merecedor da vossa maior atenção.

Esta petição foi despoletada pelo caso de Cláudia Simões, a mulher detida e agredida por agentes da Polícia de Segurança Pública no dia 19 de Janeiro de 2020, num bairro da Amadora. O caso, amplamente noticiado pelos meios de comunicação social, será certamente já do vosso conhecimento.
Cláudia apanhou um autocarro acompanhada pela filha de oito anos que se esqueceu do passe em casa. Era de noite, estavam 8ºC, e o próximo transporte só passaria dali a mais quarenta minutos.

O motorista não consentiu a ausência do passe da criança e pediu intervenção da polícia na paragem da Falagueira. Foi durante a intervenção dos agentes da autoridade que Cláudia Simões foi violentamente imobilizada, sufocada e esmagada contra o passeio.Tudo por alegadamente ter resistido. Tudo em frente à filha de oito anos que se esqueceu do passe em casa.

As imagens que provam a violência da detenção foram captadas por quem assistia e surgiram nas nossas televisões. O que ninguém filmou foram as agressões que continuaram, cobardemente, dentro do carro da polícia e na esquadra.

Quando Cláudia perdeu os sentidos, os polícias deixaram-na na rua e chamaram o INEM, justificando as marcas evidentes da violência com “uma queda”.

Parece um filme de terror, mas aconteceu em Portugal, em Janeiro de 2020, a poucos quilómetros do Palácio de Belém.

Há vídeos que provam a violência policial. Fotografias que mostram os efeitos do espancamento. Relatos de testemunhas que comprovam o racismo e as ofensas verbais.

Teria acontecido o mesmo se Cláudia Simões, a mãe da criança que se esqueceu do passe, fosse uma mulher branca?
Todos sabemos a resposta a essa pergunta.

Infelizmente, este não é um caso isolado. E não deve ser visto como tal. Deve ser visto como mais um exemplo do racismo que cresce dentro das forças de segurança. Juntamos, em anexo, cópias dos casos ilustrativos mais emblemáticos noticiados recentemente pela comunicação social. E lembramos, também,  a condenação recente de oito polícias de Alfragide por espancamentos e sequestro de jovens dentro de uma esquadra da Cova da Moura, pelo tribunal de Sintra.

A ideia de que a polícia está acima da lei não tem lugar num estado de direito Democrático. No Portugal de 2020, há que mostrar tolerância zero a qualquer tipo de discriminação e é preciso reiterar: a polícia não está acima da lei. Tem, aliás, obrigação de dar o exemplo e não ser, ela própria, geradora de mais violência. Se uma situação destas ocorre com uma mãe de família acompanhada da filha menor, e em frente às câmaras, imaginemos o que se poderá passar à porta fechada, no interior de esquadras e centros de detenção.
A forma como as populações mais desprotegidas e as minorias étnicas são tratadas pela autoridade é o barómetro dos direitos humanos (ou falta deles) num dado país. Rejeitamos com veemência o Portugal que ignora um incidente deste género. É preciso dar um sinal claro de que a violência policial gratuita é inaceitável num Estado de Direito.

Pedimos, por isso, que exijam medidas concretas para combater o racismo dentro das forças de segurança. Que obriguem o Ministério Público a agir rapidamente e de forma eficaz nestes casos. Que ajudem a acabar com o clima de impunidade entre os polícias.

Pedimos, também, que sejam tomadas medidas para melhor ouvir e proteger todas as pessoas que são vítimas de violência policial.

Portugal é um país diverso e tem nessa diversidade uma das suas grandes mais-valias. O respeito por outras raças, grupos étnicos e religiões deve ser uma parte integrante da nossa identidade. E tem de estar reflectido em todas as instituições públicas.

Envergonham-nos as notícias da imprensa internacional que denunciam a actuação abusiva da polícia Portuguesa (ver anexo), mas horroriza-nos mais ainda o impacto que cada situação de impunidade e violência gratuita tem nas família e em cada cidadão alvo delas. Receamos a escalada de violência que já teve início nas ruas e que se transformará numa bola-de-neve se ficarmos impassíveis perante eventos desta natureza.

Queremos deixar bem claro que esta não é uma carta de oposição à polícia, mas sim àqueles dos seus membros que lhe dão mau nome. Queremos poder continuar a confiar nas forças policiais. Queremos poder tê-las como aliadas no nosso dia-a-dia. Queremos poder olhar para um polícia como “um de nós”.
Para isso é também necessário que se introduzam reformas destinadas tanto a melhorar as condições de trabalho dos agentes como a prevenir e punir qualquer abuso de poder. Sabemos que entre os agentes que infringem o seu código deontológico tantos e tantos há que agem de forma exemplar e nos orgulham a todos.

Senhores deputados: esta petição é um grito de socorro. Os Portugueses confiam em vós enquanto cidadãos de excelência na defesa da Constituição Portuguesa, e enquanto cidadãos de coração no sítio certo. Foi por isso que os elegemos. Vimos por este meio pedir-vos que usem dos vossos meios para que sejam introduzidas reformas na polícia Portuguesa que façam com que incidentes deste género não se tornem a repetir. Vimos exortar que usem dos vossos meios para fazer justiça. As tensões raciais em Portugal são um problema ao qual temos que dar a resposta. Está na hora de atuar para prevenir uma escalada de tensão e violência racial que nos parece inevitável se nada mudar.
Está na hora de dizer basta. Basta à violência. Basta ao racismo, basta ao abuso de poder.

We are a group of citizens, from different spheres of Portuguese society, who hereby intend to expose a problem that we believe deserves your best attention.

The case of Cláudia Simões, the woman who was detained and battered by police officers on January 20, 2020, in an Amadora neighbourhood, ignited this petition.

Cláudia took a bus in the company of her eight-year-old daughter who had forgotten her monthly public transportation pass at home. It was evening, it was 8-degree celsius, and the next bus would only run in forty minutes.
The bus driver didn't allow the child to travel without a ticket and asked for the intervention of the police at Falagueira bus stop. During that intervention, police officers violently immobilized, suffocated, and smashed Cláudia Simões against the sidewalk.
All because she allegedly resisted. All in front of her eight-year-old daughter, who had forgotten her monthly public transportation pass at home.

Bystanders captured the images proving the violence of the detention that aired on national television. What nobody managed to film, however, were the aggressions that ensued, cowardly, inside of the police car and at the police station.

When Cláudia passed out, the policemen left her outside, lying on the pavement and called an ambulance, justifying the evident marks of violence with her "having fallen".

It sounds like a nightmare, but it happened in Portugal, in January 2020, a few kilometres from the Belém Palace.

Videos prove the violence of the policemen. Pictures show the effects of the battery. Testimonies of people who watched the racism and verbal aggressions are also available.

Would the same have happened if Cláudia Simões, the child's mother who forgot her bus card, would have been a white woman?
We all know the answer to that question.

Unfortunately, this is not an exception, and it should not be regarded as one. The event is yet another example of the racism that is growing inside the police force. We are attaching to this petition copies of the most emblematic examples recently covered by the media. We kindly remind you of the eight policemen from Alfragide, convicted at Sintra's courthouse by the battery and kidnapping a group of young men inside a police station in Cova da Moura.

The idea that the police is above the law does not have a place in a Democratic state. In Portugal of 2020, we must show zero tolerance to all sorts of discrimination, and again: the police is not above the law. As a matter of fact, the police must stand as an example, not the generator of more violence. If a situation like this, involving a mother accompanied by her underaged child, takes place in front of the cameras, let us imagine what can happen in closed doors, inside of police stations and detention centres.

The way the authorities treat less privileged populations and ethnic minorities is the barometer of Human Rights (or lack of them) in any given country. We vehemently reject the Portugal that ignores an incident of this kind. It is time to give a clear-cut signal that gratuitous police violence is unacceptable in a Democratic state ruled by Law.

We, therefore, urge you to demand concrete measures to combat racism inside the police force. We urge you to force the Public Ministry to act quickly and effectively in cases like this. We urge you to help put an end to the climate of impunity inside of the police force.

We urge you to take measures that ensure that the victims of police violence are better heard and protected, as well.

Portugal is a diverse country, and that diversity is one of its grandest riches. The respect for other races, ethnic groups and religions must be an essential part of our identity. All public institutions must reflect that identity.

We are ashamed of the news in the international media that denounce situations of abuse by the Portuguese police force (see attachment). However, the impact that impunity and gratuitous violence have in every family and every citizen victim of them is even more horrifying. We are afraid of the escalating violence that is already taking place on the streets, which is only to have a snowball effect if we remain impassive in the face of injustice.

We want to state clearly that this is not a letter of opposition to the police, but to those of the members that give it a bad name. We want to keep trusting the police force. We want to have them as allies in our everyday life. We want to consider a police officer as "one of us". Therefore it is as necessary to introduce reforms that improve the officers' working conditions as it is to prevent and punish any abuse of power. We stress our awareness that, among the officers that infringe their Code of Ethics, there are many more who act in an exemplary manner and make us all proud.

Dear deputies: this petition is a cry for help. The Portuguese trust that you are citizens of excellence in defense of the Portuguese Constitution, and that your hearts are in the right place. It is why we have elected you.

We now ask you to use your means to introduce reforms in the Portuguese police force that prevent events like this from happening. We exhort you to use your influence to make justice. Racial tensions in Portugal are a problem to which we need to respond. It is time that we act to prevent the escalating tension and racial violence that we see coming if nothing changes.

It is time to say enough is enough. We have had enough of violence, enough of racism, enough of abuse of power.
