Apelo ao Conselho de Segurança da ONU para assumir referendo para autodeterminação do Sahara Ocidental

Os e as abaixo assinados (as) enviam esta carta aos membros do Conselho de Segurança devido à situação alarmante no Sahara Ocidental ocupado, onde medidas sérias e práticas são urgentemente necessárias para uma conclusão bem-sucedida da descolonização do Sahara Ocidental em conformidade com as resoluções da ONU e o acordo de cessar-fogo.
As autoridades de ocupação marroquinas intensificam as suas ações repressivas e terroristas contra os civis saharauis no Sahara Ocidental ocupado. As violações sistemáticas dos direitos humanos a que é submetido o povo saharaui no Sahara Ocidental ocupado pelas autoridades de ocupação marroquinas estão a aumentar a um ritmo alarmante, tendo como alvo crianças, jovens, homens e mulheres.
Observadores internacionais, investigadores, advogados e jornalistas tiveram o acesso negado ou foram expulsos do Território pelas autoridades de ocupação marroquinas.
O exército marroquino continua a sua presença e atividades ilegais na zona tampão em Guerguerat, o que aumenta a tensão na área, colocando em risco o acordo de cessar-fogo. A brecha ilegal aberta pelo exército marroquino é uma passagem para narcotraficantes e outras atividades ilegais que comprometem a segurança de toda a região. É também uma porta de apoio ao saqueio dos recursos naturais saharauis.
Os presos políticos saharauis foram vítimas de tortura, maus-tratos e perseguições, detidos sem respeito pelos princípios mais básicos de procedimentos justos e estão sequestrados em Marrocos, alguns deles a mais de 1300 km da sua terra natal.
Até agora, Marrocos não respeitou nenhuma decisão, opinião ou medida provisória emitida pelos mecanismos de direitos humanos da ONU em relação a estes presos, especialmente os presos conhecidos como Grupo Gdeim Izik.
Os recursos naturais do povo saharaui continuam a ser pilhados pelo Reino de Marrocos em clara violação do Direito Internacional e sem qualquer benefício para o povo saharaui.
A falta de progresso no processo político, o fracasso da Missão das Nações Unidas para o Referendo no Saara Ocidental (MINURSO) até agora em implementar o mandato para o qual foi estabelecido pela Resolução 690 (1991) do Conselho de Segurança, e o atraso na nomeação de um novo enviado pessoal do Secretário-Geral para o Sahara Ocidental, perpetua o status quo da situação, aumentando a frustração do povo saharaui com as Nações Unidas.
As persistentes violações sistemáticas dos direitos humanos perpetradas pelas autoridades marroquinas contra o povo saharaui mostram a necessidade urgente de alargar o mandato da MINURSO e incluir uma componente de direitos humanos que permita o acompanhamento independente, imparcial, abrangente e sustentado da situação dos direitos humanos na área da missão.
Membros do Conselho de Segurança, a situação no Sahara Ocidental, em particular nos Territórios do Sahara Ocidental sob a ocupação ilegal marroquina, continua assustadoramente instável. O processo político está completamente paralisado e o povo saharaui perdeu a fé nas Nações Unidas e na sua missão, que lamentavelmente se tornou um espectador passivo das acções ilegais marroquinas que visam consolidar a ocupação ilegal de Marrocos de partes do Sahara Ocidental que permanece um não Território autónomo na agenda das Nações Unidas.
Nós, abaixo assinados, felicitamos o povo saharaui pela sua paciência e respeito pelos acordos assinados, nomeadamente o acordo de cessar-fogo e a sua resistência não violenta desde 1991 tem sido um exemplo para o Mundo.
Membros do Conselho de Segurança, num momento em que se espera que o Conselho de Segurança adote uma resolução sobre a renovação do mandato da MINURSO até o final do mês, apelamo-vos a:
• aconselhar as autoridades marroquinas a cumprir as decisões e opiniões dos mecanismo de direitos humanos da ONU
• expandir o mandato da MINURSO para incluir um componente de direitos humanos a fim de permitir o monitoramento independente, imparcial, abrangente e sustentado da situação dos direitos humanos na área da Missão
• fechar a brecha ilegal criada em El Guergart
• instar o Secretário-Geral a nomear um novo enviado pessoal do Secretário-Geral para o Sahara Ocidental
• tomar medidas sérias e práticas com vista a criar as condições necessárias para a MINURSO implementar o mandato principal para o qual foi originalmente estabelecida, nomeadamente a realização de um referendo justo para que o povo do Saara Ocidental possa exercer livre e democraticamente o seu direito inalienável à autodeterminação e independência, concluindo assim com sucesso a descolonização da última colônia na África.

We undersigned address this letter to the Security Council Members in view of the alarming situation in occupied Western Sahara, where serious and practical measures are urgently needed to a successful conclusion the decolonization of Western Sahara in accordance with the UN resolutions and the ceasefire agreement.
The Moroccan occupying authorities are intensifying their repressive and terrorizing actions against Saharawi civilians in occupied Western Sahara. The systematic human rights violations to which the Saharawi people in occupied Western Sahara are subjected by the Moroccan occupying authorities are mounting at an alarming rate, targeting children, youth, men and women alike.
International observers, researchers, lawyers and journalists were denied access to or expelled from the Territory by the Moroccan occupying authorities.
The Moroccan army continues its illegal presence and activities in the Buffer Strip in Guerguerat which leads to more tension in the area, endangering the ceasefire agreement. The illegal breach opened by the Moroccan army is a passage for narco traffickers and other illegal activities that undermine the security in the entire region. It is also a gateway to support the plunder of the Saharawi natural resources.
The Saharawi Political prisoners have been victims of torture, ill treatment and harassment, detained without respect for the most basic principles of fair procedures and abducted in Morocco some of them over 1300km from their homeland. So far Morocco did not heed any decision, opinion or interim measures issued by the UN Human rights mechanism regarding these prisoners, especially the prisoner known as Gdeim Izik Group.
The Natural resources of the Saharawi People continue to be plundered by the Moroccan Kingdom in a clear violation of International Law and without any benefit for the Saharawi people.
The lack of progress in the political process, the failure of the United Nations Mission for the Referendum in Western Sahara (MINURSO) so far to implement the mandate for which it was established by Security Council resolution 690 (1991), and the delay in the appointment of a new personal envoy of the Secretary General for Western Sahara perpetuate the status quo of the situation, increasing the frustration of the Saharawi People with the United Nations.
The persistent systematic human rights violations perpetrated by Moroccan authorities against the Sahrawi people show the urgent need for the MINURSO mandate to be expanded and to include a human rights component that would enable the independent, impartial, comprehensive and sustained monitoring of the human rights situation in the Mission area.
Members of the Security Council the situation in Western Sahara, particularly in the Territories of Western Sahara under the Moroccan illegal occupation, remains alarmingly unstable. The political process is completely paralyzed, and the Saharawi people have lost faith in the United Nations and its Mission that has regrettably become a passive bystander to the Moroccan unlawful actions that aim to consolidate Morocco’s illegal occupation of parts of Western Sahara that remains a Non-Self-Governing Territory on the United Nations agenda.
We undersigned congratulate the Saharawi people for their patience and respect of the agreements signed, namely the ceasefire agreement and their non-violent resistance since 1991 has been an example for the World.
Members of the Security Council at a time when the Security Council is expected to adopt a resolution on the renewal of MINURSO mandate by the end of the month, we call upon you to:
• advise the Moroccan authorities to comply with the decisions and opinions of the UN Human Rights mechanism
• expand the MINURSO mandate to include a human rights component in order to enable the independent, impartial, comprehensive and sustained monitoring of the human rights situation in the Mission area
• close the illegal breach created in El Guergarat
• urge the Secretary General to appoint a new personal envoy of the Secretary General for Western Sahara
• take serious, practical actions with a view to creating the necessary conditions for MINURSO to implement the primary mandate for which it was originally established, namely the holding of a free and fair referendum whereby the people of Western Sahara would exercise freely and democratically their inalienable right to self-determination and independence, thus bringing to a successful conclusion the decolonization of the last colony in Africa.
