PELO APOIO DO ESTADO PORTUGUÊS À QUEIXA APRESENTADA CONTRA ISRAEL NO TRIBUNAL INTERNACIONAL DE JUSTIÇA
"Os genocídios nunca são declarados antecipadamente, mas este tribunal tem o benefício das últimas 13 semanas de provas que mostram incontestavelmente um padrão de conduta e intenção relacionada que justificam como uma alegação plausível de atos genocidas".
Assim começou a sessão no Tribunal Internacional de Justiça (TIJ) em Haia, nos Países Baixos, nas palavras da advogada Adila Hassim, membro da equipa jurídica da África do Sul que acusa Israel de violação da Convenção para a Prevenção e a Repressão do Crime de Genocídio.
Desde o início da ofensiva de Israel contra a Faixa de Gaza, a 7 de outubro de 2023, o mundo tem assistido ao bombardeamento indiscriminado de infraestruturas – hospitais, campos de refugiados, escolas, tribunais, mesquitas, igrejas ou edifícios governamentais – e população civil. Concomitantemente, restringiu o acesso a bens essenciais como alimentos, eletricidade e combustível. Todo o território de Gaza é um potencial alvo da máquina de guerra israelita, sem exceção para as alegadas zonas seguras.
O ministério da Saúde palestiniano contabiliza mais de 25 mil pessoas mortas, na sua maioria mulheres, crianças e jovens, entre elas 250 profissionais de saúde e 101 jornalistas. Esta é também a guerra que vitimou mais funcionários da Organização para as Nações Unidas (ONU), mais de 140. “Algo nunca visto”, como referiu o secretário-geral António Guterres. À mortandade, somam-se ainda 63 mil feridos, 2 milhões de deslocados, 70 mil casas destruídas, 180 mil parcialmente destruídas, 318 escolas, 23 hospitais, 57 clínicas e 90 ambulâncias.
A queixa apresentada pelo Estado sul-africano visa parar o genocídio e impedir a escalada da guerra. Diversos países, como o Brasil, a Colômbia, a Jordânia ou o Líbano, têm apoiado esta iniciativa. O Estado português, na senda das suas disposições constitucionais, deve fazer o mesmo.
Assim, os peticionários instam o Governo da República Portuguesa a expressar o seu apoio à queixa apresentada pela África do Sul contra o Estado de Israel no Tribunal Internacional de Justiça.

FOR THE SUPPORT OF THE PORTUGUESE STATE TO THE COMPLAINT FILED AGAINST ISRAEL AT THE INTERNATIONAL COURT OF JUSTICE
"Genocides are never declared in advance, but this court has the benefit of the last 13 weeks of evidence that indisputably shows a pattern of conduct and related intent that justify as plausible an allegation of genocidal acts."
So began the session at the International Court of Justice (ICJ) in The Hague, the Netherlands, in the words of lawyer Adila Hassim, a member of the South African legal team accusing Israel of violating the Convention on the Prevention and Punishment of the Crime of Genocide.
Since the beginning of Israel's offensive against the Gaza Strip on October 7, 2023, the world has witnessed the indiscriminate bombing of infrastructure - hospitals, refugee camps, schools, courts, mosques, churches or government buildings - and the civilian population. At the same time, it has restricted access to essential goods such as food, electricity and fuel. The entire territory of Gaza is a potential target for the Israeli war machine, with no exception for the alleged safe zones.
The Palestinian Ministry of Health counts more than 25,000 people killed, mostly women, children and young people, including 250 health workers and 101 journalists. This is also the war that has killed the most United Nations (UN) employees, more than 140. "This is unprecedented," as Secretary-General António Guterres said. The death toll also includes 63,000 wounded, 2 million displaced, 70,000 houses destroyed, 180,000 partially destroyed, 318 schools, 23 hospitals, 57 clinics and 90 ambulances.
The complaint filed by the South African state aims to stop the genocide and prevent the war from escalating. Several countries, such as Brazil, Colombia, Jordan and Lebanon, have supported this initiative. The Portuguese state, in line with its constitutional provisions, must do the same.
The petitioners therefore call on the Government of the Portuguese Republic to express its support for the complaint filed by South Africa against the State of Israel at the International Court of Justice.
